Information clause for job applicants

In accordance with Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), I inform you that:

  2. In all matters concerning the processing of personal data, the Data Protection Officer can be contacted via e-mail: [email protected] or at telephone number: 22 350 01 40.
  3. Purpose and legal basis for processing:
  1. in order to carry out the recruitment process, based on the entitlement under Article 22¹ of the Labor Code, in terms of: name and surname, date of birth, contact details, education, professional qualifications and history of previous employment. The basis for the processing of the aforementioned personal data is a legal obligation (Article 6(1)(c) of the RODO),
  2. in order to carry out the recruitment process, on the basis of your consent to the processing of your personal data, i.e. personal data other than those indicated in the paragraph above, provided in your resume, form, cover letter and other documents. The basis for processing is the aforementioned consent (Article 6(1)(a) RODO),
  3. in order to realize the legitimate interest of the administrator with regard to the data obtained from you during the recruitment process in connection with the verification of your skills and abilities needed for the position specified in the advertisement. The basis for processing this data is our legitimate interest (Article 6(1)(f) RODO),
  4. for the purpose of fulfilling the legitimate interest of the administrator in the event of a legal need to prove facts, to demonstrate the fulfillment of obligations (the basis of Article 6(1)(f) of the RODO),
  5. for the purpose of conducting future recruitment processes, based on your consent to the processing of personal data provided in your resume, form, cover letter and other documents. The basis for the processing is consent (Article 6(1)(a) RODO).
  1. Rights of data subjects

In accordance with the RODO, you have the right to request access to your personal data and to receive a copy of it, the right to request rectification (amendment), deletion or restriction of the processing of your personal data, and the right to portability of your personal data.

At any time you have the right to object to the processing of data, processed on the basis of Article 6(1)(f) RODO, indicated above in point.3.

The above requests can be sent to the addresses indicated in point I.

In addition, under the RODO, you have the right to file a complaint with the President of the Office for Personal Data Protection.

  1. Data retention period
  1. to the extent indicated in points 3.1, 3.2 and 3.3, your data will be kept for the time necessary to carry out this recruitment, but no longer than 1 month after the selected candidate is hired.
  2. to the extent indicated in Section 3.4, your data will be stored for the period of the statute of limitations for claims under the law, as well as for the period of time for which regulations require us to store data,
  3. to the extent indicated in paragraph 5.5, your personal data will be stored for a period of 12 months from the date of consent.
  1. Data recipients.

Your personal data may be transferred to authorized institutions as defined by law and to processors who provide services to the Data Controller and to whom the data are entrusted.

  1. In the course of our recruitment process, we collect personal data of our job candidates. We obtain personal data in two ways, directly from candidates, including through the websites pracuj.pl, gowork, aplikuj.pl, infopraca.pl, justjoinit, nofluffjobs or from third parties, in particular:
  • From the resources of Marcel S.A.;
  • From recruitment agencies, employment agencies, intermediaries and service providers;
  • From publicly available data sources such as Linkedin;
  • From marketing or event agencies to the extent that it is data used for recruitment processes.

Marcel S.A. also processes employee's personal data provided directly by the employee or from the third parties indicated above. 

  1. Your personal data will not be transferred to third countries or international organizations.
  2. Provision of personal data in the scope of name, date of birth, contact details, education and previous employment history is a condition for taking part in a given recruitment process. For the rest, providing personal data is voluntary.
  3. Automated decision-making

Please be informed that we do not make decisions by automated means, including profiling.

  1. Consent and information about the possibility of withdrawing consent

You have the right to withdraw your consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing that was carried out on the basis of your consent before its withdrawal. A statement of withdrawal of consent to the processing of personal data can be sent to the addresses indicated in Section I.
